Constitutional Study: Money

Update: Sorry, my premise for this post is probably invalid and I won't likely pursue it further. But I'm still pissed about it.

This is an incomplete post which I hope to finish later today.


Section 10. No state shall enter into any treaty, alliance, or confederation; grant letters of marque and reprisal; coin money; emit bills of credit; make anything but gold and silver coin a tender in payment of debts; pass any bill of attainder, ex post facto law, or law impairing the obligation of contracts, or grant any title of nobility.



We've been hearing about some businesses and now a credit union who are encouraging their customers to use Mexican pesos for transactions, etc. instead of converting them to US Dollars. This is happening here in the US. And it is against everything I have even learned about how things are supposed to be in our country. It's an outrage and I don't know why more people aren't revolted and protesting this obvious new step in the Mexican Invasion.

Come on people. Can't you see what is happening here? It is unConstitutional for States and citizens to trade in non-US legal tender in the United States.

There are so many crimes at play here that I can't list them all.

It's all about the $$. Those businesses will attract clientele away from other, not-so-user-friendly businesses. Then, it's easy for them to go to the bank and make their conversions. I don't know that it's illegal and perhaps they ought to be congratulated for their entrepreneurial spirit, but it sure rubs me the wrong way.

Here's what Teddy Roosevelt had to say about the issue in general back in 1907 (verified through Snopes).

"In the first place, we should insist that if the immigrant who comes
here in good faith becomes an American and assimilates himself to us, he
shall be treated on an exact equality with everyone else, for it is an
outrage to discriminate against any such man because of creed, or
birthplace, or origin. But. this is predicated upon the man's becoming
in very fact an American, and nothing but an American. There can be no
divided allegiance here. Any man who says he is an American, but
something else also, isn't an American at all. We have room for but one
flag, the American flag ... and this excludes the red flag, which
symbolizes all wars against liberty and civilization, just as much as it

I may be wrong, but I think this type of situation was what Teddy had in mind. America's a melting pot, a blended society, not a nation of Irish-Americans, Mexican-
Americans, Italian-Americans, African-Americans, etc. We're Americans. Period.

Hi dh!

I totally agree with the Roosevelt quote and your analysis of it. I haven't had time to go back and add links to the news stories and stuff for this post. What makes me really sad is that so many Americans just don't seem to care about America. Why don't some federal officials look into this situation with the foreign money being used in America? Maybe I'm mistaken, but is it not illegal to use foreign currency like that? It's just another way of ripping off the American taxpayers.

Hi Rae Ann -

It's not my area of expertise, but I don't think it's illegal to accept foreign currency in exchange for services. Title 18 of the United States Code, Sections 482 and following discuss the countefeiting of foreign currencies and the passing (uttering) of counterfeit foreign currencies, but I couldn't find anything that prohibited the use of foreign currencies in the US. Same with foreign securites (Sections 477 and following).

Where the government is concerned, as long as the currency is legitimate and the appropriate taxes are paid by the affected businesses, it's all good. As far as the taxpayers, where is the harm to them? Except in situations where the exchange rate is at issue, and in those cases, caveat emptor.

Having said all that, I go back to the Roosevelt quote and the spirit in which it was said. Welcome to America. We'll treat you as one of our own...just assimilate and become one of us...American, not hyphenated American.

Well Rae, you already know how I feel about the illegals. Them bassturds steal money right outta my pocket so I agree with that one comedian about how to close the border: flaming river of gasoline.

This peso activity might not be illegal but we're all entitled to be mighty angry about it.
